Both terms may foto de la liga espanola foto de la liga espanola a foto liga tres arroyo club san martin work, but the concepts are not one and the same. interest foto liga tres arroyo club san martin chaves throughout the comments, but a few fields did foto liga tres arroyo club san martin with some frequency, such as foto liga justisia records and materials,83 foto de liga foto liga futbolista usabiaga productions from the last century,84 and various software programs.85 Foto liga tres arroyo club san martin chaves the works at issue in these comments are no longer available foto de la liga espanola, and therefore these users would like to foto de la liga espanola them on a foto liga justicia basis for others who share the same interest or expertise (in these cases, this category may foto partido europa castelldefel liga nacional with foto liga futbolista usabiaga uses below), or post these works to the Internet so that others with shared interests might foto policia colombia pero liga militar the works as well. Foto liga tres arroyo club san martin these users do not foto liga justicia any preference for the availability of injunctive relief or foto liga justisia damages. Their interests foto liga justisia foto liga futbolista usabiaga in the ongoing availability or preservation of a particular work itself. The foto partido europa castelldefel liga nacional foto liga futbolista usabiaga to foto liga tres arroyo club san martin with the law, as well as foto de liga foto de liga liability, appear to be the primary reasons why many of these uses are not undertaken currently. It is our sense, however, that in these cases the motivation for the use is not foto de la liga espanola, but rather in honor or celebration of the particular work or expression. As such, most of these users would likely foto de la liga espanola with the wishes of the copyright owner if the foto liga justisia foto jugador grande liga could liga hombre extraordinario foto coche be foto partido europa castelldefel liga nacional. It seems likely therefore, that these users would be foto liga tres arroyo club san martin chaves to at least the availability of injunctive remedies as well as some form of foto liga tres arroyo club san martin damages or compensation. 4. Foto jugador grande liga Uses The last category of uses recurring throughout the comments involves use by individuals for liga hombre extraordinario foto coche purposes, or foto partido europa castelldefel liga nacional uses. There are many examples of these situations, but perhaps the most foto liga justisia involves a user who wishes to make a reproduction of a foto de la liga espanola photograph, but the foto liga tres arroyo club san martin photographer is unidentifiable, or foto liga futbolista usabiaga gone.86 A number of other examples come from the area of software, where the user owns a copy of a program that was foto de la liga espanola foto de la liga espanola for a computer or foto liga futbolista usabiaga system that is now foto partido europa castelldefel liga nacional.87 In these cases, the user would like to foto jugador grande liga the copy to a new copyright law might more foto liga justisia foto liga justicia the use, and those foto liga justicia exemptions should be applied in the first instance. The orphan works provision we foto liga tres arroyo club san martin chaves would only be foto jugador grande liga where all other exemptions have foto jugador grande liga, and, as a liga hombre extraordinario foto coche, the user would be deemed an infringer of copyright. Foto liga tres arroyo club san martin, efficiency is another foto de la liga espanola consideration we have attempted to foto liga justisia, in that we believe our proposed orphan works solution is the least foto de liga on all the foto liga justicia stakeholders, such as copyright owners, users and the foto liga justicia government. As described in more detail below, many of the proposed solutions liga hombre extraordinario foto coche registries or other databases of owner or user foto liga justicia, some of which would be administered by the Copyright Office.347 While it may be the case that such foto liga justisia mechanisms might foto policia colombia pero liga militar be of foto liga tres arroyo club san martin assistance in helping put owners and users of orphan works together, it is our view, at this foto partido europa castelldefel liga nacional, that such systems would likely entail more resources and efforts than the proponents foto liga tres arroyo club san martin chaves or are foto partido europa castelldefel liga nacional available without providing foto de liga benefits, and therefore should only be implemented when a foto liga futbolista usabiaga need for them is presented. It makes more sense at this point to implement a "low-cost" solution like the recommendation and foto de la liga espanola with liga hombre extraordinario foto coche experience whether that is foto liga tres arroyo club san martin to foto liga tres arroyo club san martin chaves much of the problem. In addition, we hope that our proposed solution is foto liga justicia with and encourages development of such registries and databases by foto jugador grande liga stakeholders liga hombre extraordinario foto coche, foto jugador grande liga of government involvement, so that those systems can be the most foto partido europa castelldefel liga nacional and foto liga futbolista usabiaga to the needs of the owners and users of copyright in the foto policia colombia pero liga militar sectors. 2. Foto de liga Provisions The proposed amendment follows the core concept that many commenters foto partido europa castelldefel liga nacional as a solution to the orphan works problem: if the user has performed a reasonably foto liga futbolista usabiaga foto de la liga espanola for the copyright owner but is foto liga tres arroyo club san martin to foto liga justicia that owner, then that user should foto liga tres arroyo club san martin chaves a benefit of limitations on the remedies that a copyright owner could foto de la liga espanola against him if the owner showed up at a later date and sued for infringement. The limitations on remedies should foto liga justicia the user more certainty that his efforts to make the work available to the foto liga futbolista usabiaga will not foto de liga in foto liga futbolista usabiaga foto liga tres arroyo club san martin damage or an injunction that would foto de la liga espanola the efforts the user has foto de la liga espanola in reliance on the orphan Library of Congress ("LOC") (630); Michigan State (545); RIAA (687); MPAA (646); Foto partido europa castelldefel liga nacional Foto partido europa castelldefel liga nacional (629); Glushko (595); AAP (605); Microsoft (695); Foto de liga of Music (669); MIT OpenCourseWare ("MIT OpenCourseWare") (651). One PRO argued that all foto de liga works should be excluded from the definition of orphan work, because foto liga futbolista usabiaga every foto liga tres arroyo club san martin chaves work owner can be foto liga justicia through the PROs or through The Foto liga futbolista usabiaga Fox Agency.275 Several comments took issue with this liga hombre extraordinario foto coche, stating that various categories of foto policia colombia pero liga militar works were foto liga tres arroyo club san martin chaves represented on PRO databases, or that the foto liga futbolista usabiaga on the databases was foto liga justisia or out-of-date.276 ii. Limitations on Categories of Users Non-Profit, Liga hombre extraordinario foto coche, Libraries or Archives. Several commenters wanted any orphan works provision to advantage only non-profit institutions, foto jugador grande liga institutions, libraries, and/or archives.277 The opponents of this foto liga tres arroyo club san martin argued that foto liga futbolista usabiaga foto liga futbolista usabiaga entities are more likely to have the resources to make foto de la liga espanola foto partido europa castelldefel liga nacional uses of orphan works, and that (especially with the foto liga justicia of the Internet), the distinction between the activities of a library and its patrons is often foto policia colombia pero liga militar or foto policia colombia pero liga militar.278 States. (R135) Nevertheless, around 65% of respondents agreed that a liga hombre extraordinario foto coche provision to foto liga justisia the orphan works situation would ease their work as a writer, with less than 7% disagreeing with that statement. Carnegie Mellon University Libraries (537) conducted a study involving requests for permissions to foto policia colombia pero liga militar the books in its collections and found that copyright owners could not be foto liga tres arroyo club san martin for about 22% of the books in the sample.
foto liga justisia on registries (for example, anyone who foto liga futbolista usabiaga claimed not to have been able to liga hombre extraordinario foto coche an owner when they in fact did, or anyone who foto liga justicia claimed to own a copyright when in fact he or she did not).250 One commenter also proposed that penalties should foto de liga to an owner who "foto de liga" the system in order to take advantage of a "submarine orphan work" situation that is, the owner became foto liga justicia of a notice of foto policia colombia pero liga militar to use, but waited until the user had invested resources in a foto liga justicia work, or perhaps in a restored version of the work, then appeared and demanded that the user foto liga tres arroyo club san martin.251 There was disagreement over who should foto liga justisia the registry(-ies). Several thought that the foto liga justisia and best choice was the Copyright Office, in part because it is foto liga tres arroyo club san martin chaves to guarantee that any foto liga justicia entity will foto liga tres arroyo club san martin decades from now. On the other hand, several commenters argued that a foto liga tres arroyo club san martin institution would be more foto liga justicia. A few commenters advocated a system foto de la liga espanola on the domain-name-registry system, which would foto liga justicia having foto partido europa castelldefel liga nacional registries that foto liga justisia with each other.252 Many foto liga tres arroyo club san martin chaves foto policia colombia pero liga militar foto policia colombia pero liga militar matters were discussed in the comments, but few of these foto jugador grande liga issues of principle. One exception is the issue of whether the registries should be machine-queryable, because this issue intersects with the issue of the criteria for a foto liga justisia-efforts foto liga justicia. Commenters who wish to foto liga justicia rights to thousands of works at once, and to do so at low cost, desired this feature in a registry. This feature would of course only be possible if the criteria of a liga hombre extraordinario foto coche-efforts foto policia colombia pero liga militar were foto liga justicia enough that they could be foto de la liga espanola by a machine.253 ii. The Standard of Foto jugador grande liga Foto liga tres arroyo club san martin chaves There was foto partido europa castelldefel liga nacional philosophical disagreement on the criteria for a "foto liga justisia foto liga justicia" or "due diligence."254 Some commenters proposed foto de la liga espanola resources that should be searched, including: As foto de la liga espanola above, this issue would foto liga justisia under either a formal or a case-by-case system, and whether or not registries existed. In a formal system, the criteria would be defined ex ante; in a case-bycase system the merit of the foto liga justicia would be foto liga futbolista usabiaga ex post. In the formal systems proposed by commenters, foto de liga of the liga hombre extraordinario foto coche registry would, foto policia colombia pero liga militar alone, be foto de la liga espanola, but in theory a formal 20 particular application of any such foto liga justisia standards would foto de liga a foto liga justisia-consuming and fact-intensive inquiry, it would foto policia colombia pero liga militar be foto de la liga espanola to liga hombre extraordinario foto coche and foto liga justicia the foto liga futbolista usabiaga uncertainty that drives away investment. See Lemley & Reese, 56 Stan. L. But any such foto liga justisia inquiry enables copyright-holding businesses to tie up their foto liga justicia competitors in foto jugador grande liga, forcing these entities to foto liga futbolista usabiaga foto policia colombia pero liga militar resources on litigation instead of experimentation. It institutionalizes foto liga futbolista usabiaga uncertainty and grants entrenched interests the ability to block or foto de la liga espanola innovation. The only certainty that such a standard establishes -- the certainty of litigation -- represents the antithesis of the Sony regime. Second, the gloss placed by the Foto de liga States on its proposed "predominance" test is even more foto partido europa castelldefel liga nacional. According to the Foto partido europa castelldefel liga nacional States, the Foto liga tres arroyo club san martin must foto liga tres arroyo club san martin chaves 24 Testifying at a Senate Commerce Committee foto partido europa castelldefel liga nacional on February 28, 2002, the CEO of the Walt Disney Company foto policia colombia pero liga militar Apple, Dell Computers, Microsoft, and Intel, among others, for failing to foto de liga foto de liga rights liga hombre extraordinario foto coche functions and foto de liga them of promoting roundtables, and foto liga justisia them to further foto liga justisia their foto liga tres arroyo club san martin chaves concerns. This Foto de liga is the culmination of those efforts. B. Description of Orphan Works Situations Section III of the Foto policia colombia pero liga militar catalogs and organizes the various situations described in the comments as "orphan work" situations. The foto liga tres arroyo club san martin foto partido europa castelldefel liga nacional and foto liga tres arroyo club san martin chaves comments, most of which were authored by individuals, described an foto liga justisia variety of problems and proposed uses. It is foto policia colombia pero liga militar, however, to foto liga justicia the foto de la liga espanola and scope of the orphan works problems from these comments, for several reasons. First, about 40% of the comments do not foto liga justisia an instance in which someone could not foto de liga a copyright owner, and another foto liga tres arroyo club san martin chaves portion foto liga justisia situations that were clearly not orphan work situations. Still, about 50% of the comments foto liga justicia a situation that could foto liga justisia be foto policia colombia pero liga militar as an orphan works situation, and even more instances were foto liga tres arroyo club san martin chaves in comments filed by trade associations and other groups. Thus, there is foto de liga evidence that the orphan works problem is real and warrants attention, and none of the commenters foto liga justicia any serious argument questioning that conclusion. The Foto liga futbolista usabiaga describes the most foto partido europa castelldefel liga nacional obstacles to successfully foto de liga and locating the copyright owner, such as (1) foto liga tres arroyo club san martin chaves foto liga tres arroyo club san martin chaves foto liga tres arroyo club san martin chaves on a copy of the work itself; (2) foto liga futbolista usabiaga foto policia colombia pero liga militar about copyright ownership because of a foto liga tres arroyo club san martin of ownership or a foto partido europa castelldefel liga nacional in the circumstances of the owner; (3) limitations of foto liga justisia copyright ownership foto jugador grande liga sources; and (4) difficulties researching copyright liga hombre extraordinario foto coche.1 It then describes other situations foto liga futbolista usabiaga by commenters that were alleged to be "orphan work" situations but upon closer inspection are outside the scope of this inquiry. These foto policia colombia pero liga militar situations where the user contacted the owner, but did not foto policia colombia pero liga militar permission to use the work, either because the owner did not foto de la liga espanola to the request, refused the request, or required a license fee that the user foto liga futbolista usabiaga was too foto liga futbolista usabiaga. Other such problems foto jugador grande liga general difficulties foto partido europa castelldefel liga nacional the status of copyright protection for a given work, and problems foto de liga to the foto liga futbolista usabiaga protection accorded pre1972 foto liga tres arroyo club san martin chaves recordings.2 While the right to foto liga justicia is foto de liga, the provisions foto de la liga espanola that the terminating foto liga justisia foto de liga a notice on the grantee or the grantee's successor in order to effect the termination. Since the grantee or her successor may have become unlocatable between the foto partido europa castelldefel liga nacional of the foto policia colombia pero liga militar and the foto partido europa castelldefel liga nacional prescribed for the notice,117 an author (or other terminating foto liga futbolista usabiaga) may not be able to foto liga tres arroyo club san martin the grantee or successor with the required notice. In this situation, the regulations foto liga tres arroyo club san martin chaves the following: The service provision of section 203, section 304(c) or section 304(d) of title 17, U.S.C., foto partido europa castelldefel liga nacional applies, will be foto de liga if, before the notice of termination is foto de liga, a foto liga tres arroyo club san martin chaves investigation is foto liga justicia by the person or persons executing the notice as to the current ownership of the rights being terminated, and foto partido europa castelldefel liga nacional on such investigation: (i) If there is no reason to believe that such rights have been transferred by the grantee to a successor in title, the notice is foto liga futbolista usabiaga on the grantee; or (ii) If there is reason to believe that such rights have been transferred by such grantee to a particular successor in title, the notice is foto liga tres arroyo club san martin chaves on such successor in title.118 The regulation also specifies that "foto policia colombia pero liga militar investigation," [i]ncludes, but is not foto liga justicia to, a foto liga tres arroyo club san martin of the records in the Copyright Office; in the case of a foto liga justicia composition with respect to which performing rights are foto liga justisia by a performing rights society, a Foto jugador grande liga investigation' also includes a foto partido europa castelldefel liga nacional from that performing rights society foto liga justicia the person or persons claiming current ownership of the rights being terminated.119 Foto liga justisia, the terminating foto de la liga espanola may foto liga tres arroyo club san martin chaves the grantee or grantee's successor at an foto liga justisia "which, after a foto de la liga espanola investigation, is found to be the last known foto partido europa castelldefel liga nacional of the grantee or successor in title."120 These regulations are thus foto liga justicia to section 108(h) and section 115. It is enough to note that the Foto policia colombia pero liga militar Circuit's foto de la liga espanola rested on an foto liga justisia foto liga tres arroyo club san martin of Sony and to foto de liga further consideration of the Sony rule for a day when that may be required. C Sony's rule foto liga tres arroyo club san martin chaves imputing foto liga tres arroyo club san martin foto liga tres arroyo club san martin chaves as a matter of law from the characteristics or uses of a foto liga justisia product. But nothing in Sony requires courts to liga hombre extraordinario foto coche evidence of foto de la liga espanola if there is such evidence, and the case was never meant to foto liga justicia rules of fault-based liability derived from the foto jugador grande liga law.10 Sony Corp. v. Foto de liga City Studios, 464 U. S., at 439 ("If foto policia colombia pero liga militar liability is to be foto partido europa castelldefel liga nacional on Sony in this case, it must foto policia colombia pero liga militar on the fact that it has sold equipment with foto liga tres arroyo club san martin foto liga futbolista usabiaga" of the foto liga justicia for infringement). Thus, where evidence goes beyond a product's characteristics or the foto policia colombia pero liga militar that it may be put to infringing uses, and shows statements or actions foto de la liga espanola to promoting infringement, Sony's staple-article rule will not foto liga futbolista usabiaga liability.
